I/We have completely read and understood the Palm Springs Vintage Market Rules and Regulations outlined, and hereby agree that I/We will comply and adhere to these Rules and certify that the above signed is the responsible party for this application. I/We further agree to indemnify, defend, and hold harmless Uptown Productions, Mojave Flea LLC, and the City of Palm Springs, and their officers, directors, employees, and attorneys against any and all damages, liabilities, law suits, claims and/or damages arising out of negligence, error, omission, intentional acts, or any other cause.

No refunds.

PERMITS: Sellers must have a SELLER’S PERMIT from the CA Department of Tax and Fee Administration (CDTFA). A copy of your permit number MUST accompany your application. It is a CA law requirement that sellers must have a seller’s permit number.  For general questions call 1-800-400-7115.

LIABILITY INSURANCE: All Sellers/Vendors must provide a photocopy of their business Certificate of Insurance with a minimum one million dollars ($1,000,000. 00) liability insurance naming both Uptown Productions LLC, Mojave Flea LLC, and the City of Palm Springs as additional insured. Homeowner’s insurance will not be accepted. Any Sellers/Vendors not holding liability insurance can purchase insurance directly from Shahinian Insurance Services Inc. 1-800-457-2231.

DRIVER’S LICENSE: All Sellers/Vendors must provide a valid driver’s license number with their application.

SELLING SPACE ALLOTMENT: Sellers/Vendors selling spaces/booths sizes vary. An individual selling space size is allotment 10’ width x 10’ depth . Market management makes all determination as to space assignment and configuration. Selling spaces are pre-marked. Seller’s/Vendor’s merchandise must remain within space boundaries. Sellers/Vendors do not have ownership rights to selling space. Overnight parking, storage of any vehicle or equipment, including camping is not allowed on site. Market management reserves the right to refuse assignment of space to any Sellers/Vendors that does not adhere to the rules and regulations or for any other lawful reason. The Sellers/Vendors should report to the Market management any hazardous condition which may be found in or around Seller’s/Vendor’s booth.

SELLER/ VENDOR BOOTHS: Sellers/Vendors must keep their booths clean at all times and remove all trash when leaving the Market. Sellers/Vendors must take their trash to the dumpsters and NOT leave it in the refuse containers in the market. Sellers/Vendors signs must not extend over public walking areas as this may cause accidents. Signs MUST be printed / created by computer or professionally produced. No handwritten signage will be permitted. All tables must be covered with tablecloths with all merchandise under the table must be covered and out of sight. All canopies must be weighted to prevent risk of property or personal damage due to wind. Anchors are not to be inserted into the asphalt surface. Merchandise may not be sold or displayed on the ground. Seller/Vendor accepts full and responsibility for any injury to persons or property relating in any manner to the setup, display, sale, exchange or use of the Seller/Vendor’s merchandise, equipment or other property, or of the assigned ground space by Seller/Vendor and/or Seller’s/Vendor’s employees, agents, helpers, and independent contractors. Seller/Vendor agrees to indemnify and defend Uptown Productions LLC, Mojave Flea and the City of Palm Springs and their officers, directors, employees, attorneys, and to hold them free of and harmless from, at Seller’s/Vendor’s sole expense, against any and all such liabilities, claims and/or damages. Sellers/Vendors are responsible for seeing that all electrical cords are taped down and put in such a way that they cannot be tripped on by customers, Sellers/Vendors and staff. The Seller/Vendor is completely responsible for any accidents that occur due to their placement of these cords. It is required by the Americans with Disabilities Act (ADA) that all Sellers/Vendor provide reasonable accommodation and access to goods and services for handicapped individuals.

PRODUCTS AND SERVICES: Market management requires that all Sellers/Vendors abide by all copyright laws. Seller/Vendor agrees to indemnify and hold Uptown Productions LLC, Mojave Flea LLC, and the City of Palm Springs harmless from any expenses such as attorney fees, judgments and/or settlements which management incurs as a result of claims that Seller/Vendor is selling infringing items. The sale of pornographic items, alcohol, tobacco or firearms, live animals and weapons of any kind is prohibited. The Sellers/Vendors agrees Uptown Productions LLC, Mojave Flea LLC and the City of Palm Springs are not responsible for any Seller/Vendor products sold and cannot guarantee any products. Sellers/Vendors individually accept responsibility for their products and wares. All merchandise must be vintage (at least 20 years old).  Reproductions and new collectables are not permitted however original designs from upcycled materials will be considered.  Booths will be checked to assure all merchandise is vintage/antique.  Items that are not permitted must be removed.  Repeat offenders will not be permitted to return.

SET UP AND TEAR DOWN: Sellers/Vendors and workers must arrive for booth set up no earlier than 5:00AM and must be checked in by 6:00 AM. You will lose your space if you are not on site, or do not call by that time. The Market closes at 2:00 PM. DO NOT tear down your booth prior to 2:00 PM. Sellers/Vendors must exit the site no later than 4:00 PM. No Seller/Vendor may leave the Market prior to closing.

CANCELLATION POLICY:
We are sorry but there are no refunds.

MISCELLANEOUS: Palm Springs Vintage Market Rules and Regulations, including the fee schedule and other terms and conditions, are subject to change without advance notice at any time. Seller/Vendor agrees Market management is not responsible for any lost, damaged, or stolen articles. Sellers/Vendors should safeguard their belongings. Sellers/Vendors shall not play loud music which can be heard outside of their space(s). Any loud selling solicitations should not be directed at any individual customers and be respectful of surrounding Sellers/Vendors. Market management reserves the right to take photographs, or video of any Seller/Vendor booths which may be utilized by Market management for promoting and advertising the Market. Seller/Vendor agrees to pay reasonable attorneys fees and costs incurred to Uptown Productions LLC, Mojave Flea LLC and the Ci ty of Palm Springs, should legal action be instituted by reason of Seller’s/Vendor’s failure to comply with any of these Seller/Vendor Regulations. Sellers/Vendors are strictly responsible for the actions of their agents, employees, helpers, and/or independent contractors who work with and/or help them. Sellers/Vendors may not sell any kind of ‘knock off’ or copyright infringement items. Sellers/Vendors agree to hold Uptown Productions LLC, Mojave Flea LLC and the City of Palm Springs harmless in case of an act of God, such as earthquake or flood. Sellers/Vendors are responsible for their employees, vehicles, tents, merchandise, and all liability relating to same. Seller/Vendor agrees to hold harmless Uptown Productions LLC, Mojave Flea LLC and the Ci ty of Palm Springs, relative to any property damage and/or bodily injury arising from any kind of heating device and gas powered generators utilized within Seller’s/Vendor’s selling space. Seller/Vendor accepts full responsibility and liability within the Market grounds. Sellers/Vendors and their employees shall behave in a professional and business manner towards the general public. All Sellers/Vendors, by submission of the online application acknowledgment and agree to these rules and regulations.
